Child support in Arizona is based upon a mathematical formula set by statute (law). The formula is updated every four years to account for cost of living increases. This formula/equation/statute is called the Arizona Child Support Guidelines. The guidelines take into account several factors, such as the parents’ incomes, the number of children and their ages, whether either parent is receiving spousal maintenance, whether either parent is paying for child care, whether either parent is paying for medical/dental/vision insurance for the child(ren), and the parenting time split between the parents.

The child support number can vary significantly based upon a party’s income, the amount of daycare paid by a party, or the amount of parenting time days a parent is entitled to. Although the guidelines are set and the child support number is straightforward once the calculation is run, there can be an issue with the numbers themselves.

Issues arise constantly with parents who have been out of the workforce for a number of years and are then faced with having income “imputed” to them based on their earning capacity. Other people are working below their earning capacity or are underemployed and litigation ensues regarding their true earning capacity. Self-employed individuals can hide personal expenses within their business in an attempt to lower their actual income. Even issues such as parenting time days, which seem like a straightforward issue, can be difficult and an issue for litigation if a parent does not exercise all of his or her days and is therefore not entitled to claim them.
